If you are a resident of Missouri who lived at a property owned by Del Hedgepath d/b/a Del Properties (“Hedgepath”) from January 1, 2014 through January 1, 2024, you may be entitled to compensation from a class action settlement.

  • The Settlement resolves a lawsuit alleging that Hedgepath engaged in identical predatory leasing practices with each member of each class.
  • The two sides disagree on whether the Plaintiff and the Settlement Class could have prevailed at trial. By entering into the Settlement, Hedgepath has not conceded the truth or validity of any of the claims against it and denies any liability or wrongdoing.
  • Hedgepath has agreed to pay settlement benefits, and other expenses, as described below, to fully resolve and release the claims of members of the Settlement Classes:
    • Class A: All Missouri tenants who resided at 501 W. 11th St., Kansas City, Missouri from January 1, 2014 through January 1, 2024.
    • Class B: All Missouri tenants sued by Hedgepath pursuant to a residential lease from January 1, 2014 through January 1, 2024, who terminated their lease prior to the original end date of the lease. Membership in this Class does not depend on which name Hedgepath used in interacting with the class member.
    • Class C: All Missouri tenants from whom Hedgepath collected a security deposit pursuant to a residential lease from January 1, 2014 through January 1, 2024. Membership in this Class does not depend on which name Hedgepath used in interacting with the class member.
  • In addition to the other benefits provided to the Settlement Class Members, starting within 90 days from when the Settlement Agreement was executed and continuing for a period of two years from the Effective Date, Hedgepath will make changes to their lease terms and enforcement of lease provisions as explained in the Notices and in FAQ 4.
  • Your legal rights may be affected whether you act, or don’t act. Read the Notices carefully.

Your Legal Rights and Options

Do Nothing

If you do nothing, you will receive a payment based on your Class membership, which will be mailed to your last known address. You do not need to file a claim to receive this payment.

Exclude Yourself From the Case

This is the only option that allows you to sue Defendant on your own regarding the legal claims in this case, but you will not receive compensation under the Settlement. The deadline for excluding yourself is October 1, 2024.

Object to the Settlement

Write to the Court about why you do not like the Settlement. A Settlement Class Member who objects still remains in the Settlement Class and will receive a Settlement Benefit. The deadline for objecting is October 1, 2024.

  • These rights and options – and the deadlines to exercise them – are explained in the Notices.
  • The Court in charge of this case must still decide whether to approve the Settlement. Settlement Benefits will be issued if the Court approves the Settlement, and after appeals are resolved, if any.
